These Website Terms of Use ("Terms") govern your access to and use of pinkapple.agency and any Pink Apple Agency LLC website, form, scheduling page, chat, AI-assisted feature, proposal page, or online service that links to these Terms (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About Pink Apple and These Terms
The Site is operated by Pink Apple Agency LLC ("Pink Apple," "we," "us," or "our"), a Pennsylvania limited liability company operating from South Carolina. The Site presents information about services that may include web design and development, brand identity, social media management, paid advertising, marketing automation, and video and content creation.
These Terms govern use of the public Site. They are not a master services agreement, statement of work, proposal, subscription agreement, hosting agreement, or other client contract. If you become a client, the written agreement, accepted proposal, statement of work, checkout terms, and related documents for the service will control. If those documents conflict with these Terms on a client-service issue, the client documents control.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site. If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
3. Information Only; No Client Relationship
Site content is provided for general business and informational purposes. Submitting a form, scheduling a consultation, using chat, receiving an automated response, discussing a project, or receiving a proposal does not by itself create a client, fiduciary, partnership, employment, or professional-advisor relationship. A client relationship begins only when Pink Apple and the client accept an applicable written agreement or proposal and any required initial payment is made.
4. Services, Pricing, and Results
Service descriptions, examples, packages, timelines, availability, and prices on the Site may be general, illustrative, or subject to additional requirements. Pink Apple may change or withdraw an offering before accepting an order or agreement. A package includes only the deliverables expressly identified in its applicable proposal, checkout page, or service terms.
Pink Apple does not guarantee search-engine rankings, advertising approval, account availability, lead volume, lead quality, conversions, sales, traffic, revenue, audience growth, or any other business result. Results depend on factors outside Pink Apple’s control, including market conditions, client responsiveness, offer quality, platform policies and algorithms, budgets, competition, and third-party systems. Any case study, testimonial, projection, or example reflects a particular situation and is not a promise that another user or client will obtain the same result.
5. Online Proposals, Packages, and Purchases
The Site may allow a user to review or accept a proposal or, in the future, purchase a defined service package without a consultation. Additional terms presented with the proposal, package, invoice, or checkout are incorporated into the transaction. An order is subject to acceptance by Pink Apple, successful payment, accurate information, and the availability and scope stated for the offering. Pink Apple may reject or cancel an order and issue any refund required by the applicable terms or law if the requested work is unavailable, outside scope, unlawful, deceptive, infringing, or inconsistent with platform rules.
6. Permitted Use
Subject to these Terms, Pink Apple grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful personal or internal business purposes. You may not use the Site in a way that violates law, another person’s rights, or these Terms.
7. Prohibited Conduct
You may not:
- Access or use the Site for an unlawful, fraudulent, deceptive, abusive, harassing, discriminatory, or infringing purpose.
- Attempt to gain unauthorized access to the Site, accounts, servers, source code, data, or connected systems.
- Interfere with, damage, overload, probe, scan, or disrupt the Site or another user’s access.
- Upload or transmit malware, malicious code, harmful files, or content designed to compromise a system.
- Scrape, crawl, harvest, index, copy, reproduce, republish, train a model on, or commercially exploit Site content except with Pink Apple’s written permission or as permitted by law.
- Remove ownership notices, bypass security or access controls, reverse engineer Site functionality, or use automated tools in a manner that places an unreasonable load on the Site.
- Impersonate another person or business, misrepresent your authority, or submit information you do not have the right to provide.
- Use the chat or AI assistant to generate harmful, unlawful, deceptive, infringing, regulated, or high-impact advice, or to submit confidential or sensitive information.
- Copy or present Pink Apple’s original designs, branding, templates, copy, code, graphics, processes, or materials as your own.
8. Information and Materials You Submit
You retain ownership of materials you submit, subject to the rights of any other owner. You grant Pink Apple and its service providers a limited, nonexclusive license to host, copy, transmit, modify, and use submitted materials only as reasonably necessary to respond to your inquiry, operate the Site, provide requested services, protect the Site, and comply with law.
You represent that the information you provide is accurate and that you have all rights and permissions needed to provide any names, logos, images, videos, music, text, data, testimonials, or other materials. Do not submit confidential, sensitive, regulated, unlawful, deceptive, or infringing materials through general website features.
Pink Apple will not publicly use the contents of a private inquiry merely because you submitted it. If you submit or approve a testimonial, review, logo, project result, or portfolio item for publication, you authorize Pink Apple to display and reasonably format that material for promotional and portfolio purposes, subject to any written client agreement or restriction you provide. Client ownership and portfolio rights are governed by the applicable client agreement.
9. Intellectual Property
The Site and its original copy, design, graphics, branding, user interface, code, templates, icons, videos, photographs owned by Pink Apple, and other materials are owned by Pink Apple or its licensors and are protected by intellectual-property and unfair-competition laws. Pink Apple Agency, the Pink Apple name, logos, and related brand elements may not be used without written permission. Client-owned work and third-party materials displayed on the Site remain subject to their respective owners’ rights.
Nothing in these Terms transfers ownership of Pink Apple’s background technology, reusable templates, internal processes, automation architecture, methods, know-how, or custom tools. Ownership of work created for a client is determined by the applicable client agreement and payment terms.
10. AI-Assisted Features
An AI assistant on the Site, if available, is an automated system intended to answer basic questions about Pink Apple’s services and help visitors begin a conversation. Responses may be incomplete, inaccurate, outdated, or generated without full context. You are responsible for reviewing information before relying on it.
The AI assistant does not provide legal, medical, insurance, financial, tax, or other regulated professional advice and should not be used to make high-impact decisions. It may discuss Pink Apple’s ability to create marketing materials for regulated industries, but it does not advise consumers about coverage, healthcare, insurance products, investments, or legal rights. Do not submit trade secrets, credentials, personal health information, financial information, insurance application data, Social Security numbers, or other confidential or sensitive information.
11. Communications
By providing contact information, you authorize Pink Apple to contact you to respond to your request, administer a proposal or transaction, or provide service-related information. This does not constitute consent to automated marketing calls or texts. If Pink Apple later offers promotional email or automated SMS marketing, any consent required by law will be requested separately. You are responsible for keeping contact information accurate.
12. Third-Party Services and Links
The Site may use or link to third-party hosting, CRM, scheduling, chat, payment, analytics, advertising, security, AI, social-media, or other services. Pink Apple does not control and is not responsible for third-party content, availability, security, terms, privacy practices, account decisions, policy changes, outages, or fees. Your use of a third-party service may be subject to that provider’s separate terms.
13. Privacy
Our Privacy & Cookie Policy explains how Pink Apple handles personal information and uses cookies and similar technologies. By using the Site, you acknowledge that Policy. Privacy choices and consents are governed by the Policy and applicable law.
14. Site Availability and Changes
Pink Apple may modify, suspend, limit, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, secure, uninterrupted, current, complete, or error-free. We may correct errors and update content without notice.
15. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available." Pink Apple disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and any warranties arising from course of dealing or usage of trade. Pink Apple does not warrant that the Site will meet every requirement, produce a particular result, or be free of errors, harmful components, or security vulnerabilities.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded. These disclaimers apply to the public Site and do not eliminate Pink Apple’s express obligations in an applicable signed client agreement.
16. Limitation of Liability
To the fullest extent permitted by law, Pink Apple and its owners, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunity, or business interruption arising from or related to the Site, even if advised that such damages are possible.
To the fullest extent permitted by law, the total liability of Pink Apple and the foregoing parties for all claims arising from or related to the Site will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid specifically for access to the Site during the twelve months before the event giving rise to the claim. This limitation does not apply to liability that cannot be limited by law, or to Pink Apple’s gross negligence, willful misconduct, or fraud. Liability relating to paid client services is governed by the applicable client agreement.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pink Apple and its owners, officers, employees, and contractors from third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Site, your material violation of these Terms, or materials you submit that infringe or violate another person’s rights. Pink Apple will provide reasonable notice of a covered claim and allow you to participate in the defense. This section does not require indemnification for Pink Apple’s own gross negligence, willful misconduct, or fraud.
18. Suspension and Termination
Pink Apple may suspend or terminate access to the Site when reasonably necessary to protect the Site, users, clients, or third parties; investigate suspected misconduct; comply with law; or address a material violation of these Terms. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limitations, indemnification, dispute terms, and miscellaneous provisions, will survive.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except where another law cannot validly be waived.
Before filing a claim relating to the Site, you and Pink Apple agree to make a good-faith effort to resolve the dispute informally. The complaining party must send written notice describing the dispute and requested resolution. The parties will have 30 days after receipt to attempt resolution. If the dispute remains unresolved, either party may request nonbinding mediation in Richland County, South Carolina. Unless otherwise agreed, the parties will share the mediator’s fees equally and bear their own other costs.
If mediation is not requested, is declined, or does not resolve the dispute, either party may bring the claim in a state or federal court with jurisdiction in Richland County, South Carolina, and each party consents to that venue and jurisdiction. Either party may seek temporary or injunctive relief without completing the informal or mediation process when necessary to protect intellectual property, confidential information, security, or prevent imminent harm.
20. Changes to These Terms
Pink Apple may update these Terms to reflect changes in the Site, services, technology, or law. The updated Terms will be posted with a revised effective date. If a change materially affects registered or current users and Pink Apple has appropriate contact information, we may also provide notice by email or a prominent Site notice. Continued use after the effective date means you accept the updated Terms, except where applicable law requires a different form of consent.
21. Copyright and Rights Concerns
If you believe content on the Site infringes your copyright, trademark, privacy, or other rights, email contact@pinkapple.agency with enough information to identify the material, the claimed right, your contact information, and the requested action. Pink Apple may request additional information before acting.
22. Miscellaneous
These Terms and the incorporated Privacy & Cookie Policy form the entire agreement concerning use of the public Site, subject to any separate client or transaction agreement. If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. Pink Apple’s failure to enforce a provision is not a waiver. You may not assign these Terms without Pink Apple’s written consent. Pink Apple may assign them in connection with a reorganization, financing, sale, or transfer of the Site or business. Section headings are for convenience only.
