This Privacy & Cookie Policy explains how Pink Apple Agency LLC ("Pink Apple," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit pinkapple.agency, submit a form, communicate with us, schedule a consultation, interact with our chat or AI-assisted features, receive a proposal, or otherwise use a Pink Apple website or service that links to this Policy.

This Policy covers Pink Apple’s own business activities. When Pink Apple handles leads, contacts, appointment records, or other information solely on behalf of one of our clients, that client generally controls the information. Requests about information held in a client-controlled system should be directed to that client. We may assist the client with the request when required by our agreement or applicable law.

1. Information We Collect

Information you provide

We may collect information you choose to provide, including:

• Contact information, such as your first and last name, email address, telephone number, and mailing address.
• Business and professional information, such as your business name, industry, website, role, and business needs.
• Inquiry and project information, such as the services you are interested in, project goals, budget or pricing preferences, appointment selections, and additional notes.
• Communications, including emails, messages, call notes, consultation details, support requests, and feedback.
• Proposal, contract, and billing information, including services selected, signatures, invoice status, transaction amount, and related business records.
• Project materials that you or a client provides, such as copy, logos, photographs, videos, brand guidance, account access details, and other content needed to perform agreed services.
• Testimonials, reviews, or other materials you voluntarily submit for possible publication.
• Messages, prompts, and responses submitted through a chat or AI-assisted feature, if one is available.

Information collected automatically

When you use the website, we and our service providers may automatically collect technical and usage information, including your IP address, browser type, device type, operating system, approximate location derived from IP address, referring page, pages viewed, links clicked, dates and times of activity, form and conversion events, cookie identifiers, and similar information.

Information from other sources

We may receive business contact and interaction information from referrals, social media platforms, advertising and analytics platforms, scheduling or CRM providers, public business directories, and other sources that lawfully provide the information.

Sensitive information

Do not submit Social Security numbers, government identification numbers, financial-account credentials, payment-card security codes, medical or health information, insurance application information, passwords, or other highly sensitive or regulated information through our general contact form, chat, or AI assistant. If a project requires sensitive information, Pink Apple must approve the workflow in writing before the information is provided.

2. How We Use Information

We may use personal information to:

• Respond to inquiries, communicate with you, and determine whether our services may fit your needs.
• Schedule consultations, prepare proposals, enter into and manage client relationships, and deliver contracted services.
• Operate, maintain, personalize, and improve our website, forms, chat, scheduling, CRM, and automation systems.
• Process invoices and payments, maintain business records, and manage account or project access.
• Measure website performance, understand how visitors use the site, attribute inquiries to marketing campaigns, and improve our services.
• Send service-related communications and, where you separately consent or where permitted by law, marketing communications.
• Protect the website, our systems, our clients, and others; prevent fraud, abuse, security incidents, and unlawful activity.
• Comply with legal obligations, enforce agreements, and establish, exercise, or defend legal claims.
• Operate and improve chat or AI-assisted features, subject to the limitations described in this Policy.

3. How We Disclose Information

We may disclose personal information to the following categories of recipients for the purposes described above:

• Hosting, content-delivery, security, and bot-prevention providers, including Cloudflare and, when enabled, Google reCAPTCHA.
• CRM, form, scheduling, chat, email, workflow, and marketing-automation providers used to receive and manage inquiries and client work.
• Analytics and advertising providers, including Google Analytics, Google Tag Manager, and Meta technologies, when enabled.
• Payment processors, including Stripe. Payment-card information is generally submitted directly to the processor. Pink Apple typically receives transaction details and status, not the complete card number or security code.
• Cloud storage, file, productivity, communications, and AI service providers used to support our operations or provide requested services.
• Professional advisors, insurers, auditors, and contractors that need information to perform services for Pink Apple and are subject to appropriate obligations.
• Government authorities, courts, law enforcement, or other parties when disclosure is required by law or reasonably necessary to protect rights, safety, security, or property.
• A buyer, successor, lender, or other participant in a merger, financing, reorganization, sale of assets, or similar business transaction, subject to appropriate confidentiality protections.

We do not sell personal information for money. Some privacy laws may define the use of advertising pixels or similar technologies as a "sale," "sharing," or use for targeted advertising, even when no money is exchanged. Section 6 explains how to control those technologies.

4. Payments

Pink Apple currently handles payment primarily through invoices or separately presented payment links rather than collecting payment-card details in the general website form. If Stripe or another payment provider processes a payment, that provider handles the payment information under its own privacy notice and terms. We may retain the customer name, billing contact details, transaction amount, invoice, payment status, and related records for accounting, support, fraud prevention, and legal compliance.

5. Email, Telephone, and Text Communications

Submitting an inquiry allows Pink Apple to contact you to respond to that inquiry by email or telephone. It does not automatically subscribe you to ongoing promotional email or automated marketing text messages. If we later offer marketing subscriptions or automated SMS marketing, we will request any consent required by law through a separate, optional mechanism. You may unsubscribe from promotional email by using the unsubscribe link or contacting us. Service, transaction, and legal notices may still be sent when necessary.

6. Cookies, Analytics, and Advertising Technologies

Cookies are small text files stored on a device. Similar technologies include pixels, tags, local storage, and software development tools. We may use the following categories:

Your choices

Where our cookie preference tool is available, you may accept all cookies, reject nonessential cookies, or manage categories. Rejecting nonessential cookies should prevent analytics and advertising technologies from loading after your choice is applied, although essential technologies will remain active. You may also delete or block cookies through your browser. Blocking cookies may affect site functionality.

Pink Apple does not currently use website activity to build its own retargeting audiences. However, analytics and advertising providers may process information under their own terms, and use of an advertising pixel can be treated as sharing or targeted advertising under some state laws.

Where required by applicable law and supported by our systems, we treat a recognized Global Privacy Control signal as a request to opt out of sale, sharing, or targeted advertising for that browser or device. Because there is no uniform industry standard for traditional "Do Not Track" signals, the website does not otherwise respond to those signals.

7. AI-Assisted Features

If the website offers an AI assistant, it is intended to answer general questions about Pink Apple’s services and help visitors begin a conversation. It may use a third-party AI provider to process messages and generate responses. AI output may be incomplete, outdated, inaccurate, or unsuitable for a particular purpose. Do not rely on it as a substitute for professional judgment.

The assistant does not provide legal, medical, insurance, financial, tax, or other regulated professional advice. It may discuss marketing services for businesses in regulated industries, such as creating a Medicare-related landing page, but it does not advise consumers about Medicare plans, healthcare decisions, insurance coverage, investments, or legal rights. Do not submit confidential, sensitive, or regulated information. Pink Apple personnel may review AI-assisted content before using it in client work.

8. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, subject to legal, accounting, security, contractual, and operational needs. Our current retention approach is:

• Unconverted inquiries: ordinarily up to 30 days after the last meaningful interaction, unless you request follow-up, the conversation remains active, or a longer period is reasonably necessary for legal, security, or business-record purposes.
• AI and chat conversations: ordinarily up to 30 days, unless the conversation becomes part of an inquiry, support matter, client record, or legal record governed by another period.
• Client project materials and communications: during the relationship and generally up to seven years after the last service, unless the agreement, a client request, an ongoing backup arrangement, a dispute, or law requires a different period.
• Contracts, invoices, transaction records, and tax-related records: generally seven years, or longer when required by law or needed for a legal claim.
• Google Analytics user-level and event-level data: configured for two months where the applicable settings permit; aggregated reports may remain available longer.
• Advertising and attribution information controlled directly by Pink Apple: generally up to 90 days. Providers may retain information under their own settings and policies.
• Deleted information in routine backups: removed or overwritten through the normal backup cycle, generally within 90 days.
• Nonpersonal final creative work, portfolio records, and de-identified or aggregated information: may be retained longer.

If a contract or written project agreement states a different retention or export period, that agreement controls for the applicable client materials.

9. Your Privacy Choices and Rights

Depending on your location and applicable law, you may have the right to request access to personal information, correction, deletion, portability, or information about how it is used and disclosed. You may also have the right to opt out of targeted advertising, sale, or sharing, limit certain uses of sensitive personal information, appeal a denied request, or receive equal service and pricing when exercising privacy rights.

To make a request, email contact@pinkapple.agency with the subject line "Privacy Request" or write to the address in Section 16. Describe the request and the information or interaction involved. We may take reasonable steps to verify your identity and authority. We will respond within the period required by applicable law. We may deny or limit a request where an exception applies, such as protecting another person’s rights, preserving security, completing a transaction, maintaining required records, or establishing or defending a legal claim.

Pink Apple does not discriminate against anyone for exercising an applicable privacy right. If Pink Apple processed the information solely for a client, we may direct you to that client.

10. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No website, transmission, storage system, or security measure is completely secure. You are responsible for using appropriate care when sending information and for protecting credentials or account access provided for a project.

11. Children’s Privacy

The website and Pink Apple’s services are intended for adults and business users age 18 or older. We do not knowingly offer the website to or collect personal information from children under 13. If you believe a child has submitted personal information, contact us so that we can review and, where appropriate, delete it.

12. Third-Party Websites and Services

The website may link to or embed services operated by other companies. Their privacy practices are governed by their own notices and terms. Pink Apple is not responsible for the privacy, security, content, or practices of third-party websites or services.

13. Visitors Outside the United States

Pink Apple is based in the United States and primarily serves the United States and Puerto Rico. If you access the website from another country, your information may be transferred to and processed in the United States or other locations where our providers operate. The laws in those locations may differ from the laws where you live. Pink Apple does not currently direct the website to children or actively market services to residents of jurisdictions that require a local establishment or representative.

14. Changes to This Policy

We may update this Policy to reflect changes in our services, technology, vendors, or legal obligations. We will post the revised version with a new effective date. If a change materially affects how we use information already collected, we may also provide a prominent website notice or contact affected individuals by email when appropriate.

15. State-Specific Disclosures

California and certain other state laws may require additional disclosures or provide specific rights when legal thresholds and other conditions are met. Pink Apple does not sell personal information for money. As explained above, advertising technologies may be considered sharing or targeted advertising under some laws. Applicable requests may be submitted through the methods in Section 9. Pink Apple will also honor other rights and appeal procedures required by the law that applies to the request.
